By accessing or using InstrumentaList, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Permission is granted to temporarily access and use InstrumentaList for personal, non-commercial purposes only, subject to the restrictions set forth in these Terms of Service. This is the grant of a license, not a transfer of title.
Under this license you may not:
- Modify, copy, or reproduce the materials without express written permission from InstrumentaList
- Use the materials for any commercial purpose without authorization
- Attempt to decompile, reverse engineer, or derive source code from any software contained on InstrumentaList
- Remove any copyright or other proprietary notations from the materials
- Transfer the materials to another person or "mirror" the materials on any other server
- Use automated systems (bots, scrapers, etc.) to access or collect data from the site
Unauthorized use of InstrumentaList materials, including but not limited to unauthorized copying, distribution, transmission, or commercial exploitation, may result in immediate termination of your access and may subject you to civil and/or criminal liability under applicable laws.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by InstrumentaList at any time without notice.
To use certain features of InstrumentaList, you must register for an account. When you register, you agree to provide accurate and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer.
You agree to accept responsibility for all activities that occur under your account. InstrumentaList reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.
InstrumentaList operates using a credit system for music submissions to playlists. Users can receive free credits periodically or purchase additional credits.
4.1 Free Credits
Free credits are provided at our discretion and may be modified at any time. Free credits expire as specified in our credit policy.
4.2 Purchased Credits
Purchased credits do not expire. All payments for credits are final and non-refundable unless required by law.
4.3 Payment Processing
Payment processing services are provided by Stripe. By purchasing credits, you agree to Stripe's terms of service and privacy policy.
4.4 Curator DataStore Purchases
All data purchased through the InstrumentaList Curator DataStore is licensed solely to the purchasing account holder for personal, non-commercial use. Redistribution, re-sale, public sharing, or commercial transfer of purchased curator lists - in whole or in part - is strictly prohibited and may subject the violator to monetary damages and legal action.
All one-time Curator DataStore purchases are final at the time of purchase. Each downloaded file is watermarked to the original purchaser, and unauthorized sharing is traceable.
InstrumentaList is indemnified against any use or misuse of the data provided in the Curator DataStore. The data is provided "as is" without warranty of any kind, express or implied, including but not limited to the accuracy, completeness, or deliverability of any contact information contained therein.
InstrumentaList offers PRO membership subscriptions (Artist Pro, Curator Pro, and A-List) that provide enhanced features and benefits.
5.1 Billing and Renewal
PRO memberships are billed on a recurring basis (monthly or annually) and will automatically renew at the end of each billing period unless canceled prior to the renewal date.
5.2 Refund Policy
Refunds can only be provided for the most recent billing month of an active subscription.
5.3 Cancellation
A-List memberships require a minimum of 3 months before cancellation. You can manage your subscription directly on your Profile page. If you have any other questions, please reach out to instrumentalist@instrumentalistmusic.com. Upon cancellation, you will retain access to PRO features until the end of your current billing period, after which your membership will not renew.
5.4 Modifications
InstrumentaList reserves the right to modify PRO membership pricing, features, or benefits at any time. Active subscribers will be notified of any changes and may choose to cancel their subscription if they do not agree to the modifications.
By submitting music through InstrumentaList, you represent and warrant that:
- You own or have the necessary rights to the music you submit
- Your submission does not violate any copyright, trademark, or other intellectual property rights
- Your submission complies with all applicable laws and regulations
- Your music meets the quality standards and requirements of the playlist you are submitting to
InstrumentaList is not responsible for any disputes between artists and curators regarding music submissions or playlist inclusions.
Curators approved on InstrumentaList agree to:
- Review all submissions in a timely and professional manner
- Provide appropriate feedback to artists when rejecting submissions
- Maintain active and updated playlists
- Not solicit additional payments outside the InstrumentaList platform
- Not engage in any discriminatory practices when reviewing submissions
InstrumentaList reserves the right to remove curator status from users who violate these guidelines.
By creating an account on InstrumentaList, you acknowledge and agree that InstrumentaList may include your profile, music, playlists, and other content in our weekly newsletter and other marketing communications sent to our community members.
This may include, but is not limited to:
- Featuring your tracks or playlists in our newsletter
- Highlighting your profile or achievements
- Sharing updates about your activity on the platform
- Including you in curator or artist spotlights
Opt-Out: You have the right to opt-out of being featured in our newsletter at any time. To opt-out, please contact us and specify that you would like to be excluded from newsletter features. We will honor your request within 7 business days.
The materials on InstrumentaList are provided on an 'as is' basis. InstrumentaList makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, InstrumentaList does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
In no event shall InstrumentaList or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on InstrumentaList, even if InstrumentaList or an authorized representative has been notified orally or in writing of the possibility of such damage.
The materials appearing on InstrumentaList could include technical, typographical, or photographic errors. InstrumentaList does not warrant that any of the materials on its website are accurate, complete, or current. InstrumentaList may make changes to the materials contained on its website at any time without notice.
These terms and conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
InstrumentaList may work with third-party partners and recommend tools, services, or platforms to our community through our Resource Library and other areas of the platform. InstrumentaList may earn an affiliate commission if a user signs up for or purchases one of these third-party services through a link provided on our platform.
InstrumentaList is not affiliated with, endorsed by, or in any way officially connected to these third-party services, and is not responsible or liable for any damages, losses, or issues arising from your use of any third-party tools, platforms, or services accessed outside of the InstrumentaList platform. Your use of any third-party service is entirely at your own risk and subject to that service's own terms of service and privacy policy.
